Terms of Service

1. Acceptance of Terms

By accessing or using Neul (the "Service"), available at https://neul.io, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

The Service is operated by an individual based in the Netherlands ("we", "us", or "our").

2. Early Access / Alpha Status

The Service is currently in early access (alpha stage). This means:

• The platform is under active development and may change significantly at any time
• Features may be added, modified, or removed without prior notice
• You may encounter bugs, instability, downtime, or unexpected behaviour
• Data loss is possible — do not store critical or irreplaceable data on this platform
• The Service may be discontinued at any time

By using the Service, you explicitly acknowledge that you understand and accept these risks.

We strongly recommend that you do not use Neul for critical, important, or production-grade applications during early access. The platform is best suited for small projects, side projects, and non-production workloads at this stage.

3. Description of Service

Neul provides prepaid cloud compute instances that allow users to deploy applications for a defined period ("Instances"). Instances are purchased on a prepaid basis and are valid for the period specified at time of purchase.

4. No Service Level Agreement (No SLA)

We provide no uptime guarantee, availability commitment, or service level agreement (SLA) of any kind.

• We do not guarantee that the Service will be available at any particular time or for any particular duration
• We do not guarantee that Instances will remain operational throughout the purchased period
• Scheduled and unscheduled maintenance may occur at any time without notice
• We reserve the right to suspend or terminate Instances at our discretion

5. Service Provided "As-Is"

The Service is provided strictly on an "as-is" and "as-available" basis, without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Warranties that the Service will be error-free, secure, or uninterrupted
• Warranties regarding the accuracy or reliability of any results obtained through the Service

Use of the Service is entirely at your own risk.

6. Limitation of Liability

To the fullest extent permitted by applicable law:

• Our total liability to you for any claim arising out of or related to the Service shall not exceed the amount you have actually paid us in the 30 days preceding the claim
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of business, or business interruption
• We are not liable for any loss or damage resulting from downtime, data loss, Instance termination, or any interruption to the Service

7. Prepaid Purchases and Refunds

All purchases are prepaid. You may request a full refund within 10 days of purchase, no questions asked. After 10 days, all sales are final, except where required by applicable law.

If the Service is discontinued entirely before your prepaid period expires, we will make reasonable efforts to provide a pro-rata refund.

8. Acceptable Use

You agree not to use the Service to:

• Host or distribute illegal content
• Conduct activities that violate any applicable law or regulation
• Attempt to compromise the security or integrity of the platform or other users' Instances
• Send unsolicited communications (spam) or conduct network abuse
• Mine cryptocurrency or conduct resource-intensive activities outside your allocated Instance

We reserve the right to terminate your access without refund if you violate these terms.

9. Data and Privacy

You are responsible for any data you store or process within your Instance. We do not access the contents of your Instances except where required for maintenance, security, or legal compliance. We collect basic account and payment information necessary to provide the Service. Payments are processed by Polar (polar.sh), and their terms and privacy policy also apply to your transactions.

10. Modifications to Terms

We reserve the right to update these Terms at any time. We will notify users via email or a notice on the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Netherlands. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Netherlands.
